This Notice describes how medical information about you may be used and disclosed and how you can access this information. You have the right to request a paper copy of this Notice at any time, even if you agreed to receive it electronically.
Our Organization
All clinicians at Chicago Compass Counseling are employees of the same organization and follow shared privacy policies. We use a centralized electronic health record system. Access to your record within CCC is limited based on role and need, for example, your treating clinician, required supervision, and practice operations such as billing. Your protected health information (PHI) is shared outside the practice only for treatment, payment, and health care operations, as described in this Notice, or as otherwise required or permitted by law.
Your Rights
You have the right to:
- obtain a copy of your health record
- request corrections to your record
- request that we communicate with you in a specific way or location
- ask us to limit how we use or share your information
- receive an accounting of certain disclosures we have made, including certain disclosures of substance use disorder records protected by 42 C.F.R. Part 2 when applicableÂ
- receive a copy of this Notice
- designate a personal representative to act on your behalf
- file a complaint if you believe your privacy rights have been violated
You also have the right to request that we not share information about a service with your health insurer if you pay for that service out of pocket in full, unless a law requires us to share that information.
How We Use and Share Your Information
We may use and share your health information for treatment, payment, and health care operations without a separate authorization. We may also share information as permitted or required by law, including for public health and safety purposes, mandated abuse or neglect reporting, regulatory oversight activities, workers’ compensation, law enforcement requests as permitted by law, and legal proceedings.
If your records are protected under 42 C.F.R. Part 2, certain uses and disclosures may be subject to additional federal privacy protections, including stricter consent and disclosure requirements. Information disclosed under these rules may be subject to redisclosure by the recipient and may no longer be protected by federal privacy standards.
Uses That Require Your Authorization
We will not share your information without your written permission for marketing purposes, sale of your information, or most sharing of psychotherapy notes. Chicago Compass Counseling does not contact clients for fundraising.
Filing a Complaint
You may file a complaint with the Privacy Officer listed above by email, phone, or in writing. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights by mailing a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or using the HHS OCR complaint portal. We will not retaliate against you for filing a complaint.
Our Responsibilities
We are required by law to maintain the privacy and security of your protected health information, to provide you with this Notice, and to follow the terms of the Notice currently in effect. We are also required to provide notice of your rights and our legal duties if we create or maintain records protected by 42 C.F.R. Part 2.
We will notify you if a breach occurs that may have compromised the privacy or security of your information. We may update the terms of this Notice, and changes will apply to all information we hold about you. The updated Notice will be available upon request and through the Client Portal.
